Terms of Service

These Terms of Service ("Terms") govern your access to and use of Urban Quest Live, a location-based team scavenger hunt service operated by Tangible Spark LLC ("Tangible Spark," "we," "us," or "our") at urbanquestlive.com and related mobile web applications (collectively, the "Service"). By creating an account, hosting a game, joining a game, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Urban Quest Live lets a host configure a real-world scavenger hunt in a participating city. Teams of 1–6 players register, pay an entry fee, and compete by solving clues — many generated specifically for that session — that direct them to real landmarks, which they verify by GPS check-in and/or photo. The Service is played by physically walking, biking, or driving between locations; it is not a purely digital game.

You must be at least 13 years old to create an account. Players under 18 should participate under the supervision of, and with the consent of, a parent or legal guardian, who is responsible for that player's conduct and safety during gameplay. We authenticate accounts by email; you are responsible for keeping access to that email address secure and for all activity that occurs under your account.

• Joining a game requires payment of the posted entry fee per team, currently a flat $20 regardless of team size, processed securely through Stripe. We do not receive or store your full card number.
• Discount codes (e.g., for students, veterans, or senior citizens) are subject to the eligibility criteria, expiration dates, and usage limits set for that code, and may be changed or discontinued at any time.
• Because content is generated specifically for your scheduled session shortly before it starts, entry fees are generally non-refundable once a session's content has been generated. If a host cancels a session, or a game cannot proceed due to a fault of ours, contact us and we will process a refund to your original payment method.
• You are responsible for any fees your payment provider charges you separately from the entry fee.

The Service requires moving through real-world outdoor and indoor environments, including public streets, sidewalks, parks, and businesses. You are solely responsible for your own safety and the safety of your teammates, including obeying traffic laws, watching your surroundings while using your phone, respecting posted hours and private property, and exercising good judgment about weather, terrain, and your own physical condition. Before playing, you will be asked to acknowledge a separate safety disclaimer and liability waiver; participation in a game constitutes your agreement to that waiver in addition to these Terms.

You agree not to, and not to allow anyone on your team to:

• Trespass on private property, disregard posted restrictions, or enter areas closed to the public in pursuit of a clue or checkpoint;
• Falsify GPS location, submit a photo you did not take at the required location, or otherwise attempt to circumvent checkpoint verification;
• Harass, endanger, or interfere with other teams, bystanders, or business patrons;
• Use the Service for any unlawful purpose or in a way that could damage, disable, or impair it for other players.

We may remove a team from a session, withhold points, or suspend an account for violating this section.

Photos and other content you or your team submit during a game ("User Content") are compiled into a results dashboard and photo album for that session, which are accessible via a shareable link without requiring a login, so that you and your team can share your game with others. By submitting User Content, you grant Tangible Spark a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it as part of the Service, including for promotional and marketing purposes (for example, featuring gameplay photos on our marketing site or social media). You represent that you have the right to share any User Content you submit and that it does not violate any third party's rights.

The Service, including its software, game design, clue-generation system, curated landmark data, and Urban Quest Live branding, is owned by Tangible Spark LLC and protected by intellectual property law. Except for the limited right to use the Service for personal, non-commercial gameplay, we grant you no license to our intellectual property. You agree not to reverse engineer, decompile, scrape, or otherwise attempt to extract the source code, clue-generation prompts or logic, or underlying landmark database of the Service, and not to copy, resell, or create a derivative product from the Service.

You may stop using the Service at any time. We may suspend or terminate your access to the Service, without refund, if you violate these Terms, engage in unsafe or abusive conduct, or misuse the Service in a way that harms us or other users.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT CLUES, LANDMARK INFORMATION, OR GPS VERIFICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANGIBLE SPARK LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR PARTICIPATION IN A GAME, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles, without prejudice to any mandatory consumer-protection laws of your jurisdiction.
